Contents may not promote casinos, gambling, betting, numbers games, sports, or financial betting. Contents promoting state lotteries are permitted.
- Hate/Intolerance/Discrimination: Contents may not contain or promote hate speech, personal attacks, or discrimination toward any individual, group, country, or organization.
- Obscenity/Indecency/Profanity: Contents may not contain or promote any obscene, indecent, profane, or offensive words, images, sounds, videos, or other content.
- Political/Religious: Contents may not contain hostile, offensive, inflammatory, or hateful speech related to political or religious topics or groups. Contents may not exploit controversial political, social, or religious issues for commercial purposes.
- Sexual or Adult Content: Contents may not include full or partial nudity, depictions of people in explicit positions, or activities that are overly suggestive or sexually provocative. Contents will not contain text or images exposing anyone or anything involved in explicit sexual acts or lewd and lascivious behavior. Contents may not promote escort, dating, erotic massage, pornography, or other sexual products or services.
- Disparagement/Defamation: Contents may not contain disparaging or defamatory information or content that tends to harm the reputation of Flamingo Freelance or any other individual, group, or organization.
- Gross Depictions: Contents may not contain or promote content that is crude, vulgar, degrading, or likely to shock or disgust.
- Militant/Extremism: Contents may not contain or promote extremely aggressive and combative behaviors or unlawful political measures, including individuals or groups advocating violence as a means to achieve their goals.
- Sensitive Content: Contents may not target sensitive categories such as financial status, medical conditions, mental health, criminal record, political affiliation, age, racial or ethnic origin, religious or philosophical affiliation or beliefs, sexual behavior or orientation, or trade union membership.
- Free Goods/Services: Contents may not distribute or promise to distribute any free goods and services.
- Targeted at Children: Contents may not specifically target children, including through cartoons or other similar content.
- Unverifiable Claims: Contents may not make confusing claims that reasonable consumers cannot readily understand and evaluate
- Before/After Images: Contents may not depict “before and after” images or images that contain unexpected or unlikely results.
- Health and Safety Claims: Contents may not promote actions likely to harm one’s health, such as bulimia, anorexia, binge drinking, or drug use. Contents may not make health claims that are not clearly substantiated. Advertisers may be required to submit supporting documentation to substantiate their products’ claims.
- Misleading/False/Deceptive: Contents may not contain any information or content that is potentially misleading, false, or deceptive, including content that is meant to deceptively generate clicks such as fake “close” buttons.
- Competitive to Flamingo Freelance/Affiliates: Contents may not promote direct competitors of Flamingo Freelance or any of its parent, affiliate, subsidiary, or other related entity.

- Flamingo Freelance respects the intellectual property rights of others and expects users to do the same. The User expressly agrees that the exclusive jurisdiction for any claim or action arising out of or relating to the User's use of The Flamingo Freelance Platform shall be filed only in the state or federal courts located in the USA, and the User further agrees and submits to the exercise of personal jurisdiction of such courts for the purpose of litigating any such claim or action.
12.2 Dispute Resolution; Arbitration
- If you have any dispute with or claim against us or any of our affiliates (a "Claim") arising out of or relating to the Application or this Agreement, and the claim is not resolved by calling our customer service department, you and we each agree to resolve such disputes through an individual binding arbitration or an individual action in small claims court. Class arbitrations and class actions are not permitted, and your Claim may not be consolidated with any other person's claim. You and we agree that the American Arbitration Rules govern the interpretation and enforcement of this provision and that you and we are each waiving the right to a trial by jury or to participate in a class action. - Before you commence arbitration or file a small claims court action concerning your Claim, you must first send to Flamingo Freelance a written notice of your claim ("Notice"). The Notice must:

14.0 THE CHILDREN’S ONLINE PRIVACY PROTECTION ACT (“COPPA”)
- This Provision stipulates that Flamingo Freelance needs to obtain parental consent before intentionally collecting Sensitive Information from minors under the age of 13. Flamingo Freelance does not intentionally gather or request Sensitive Information from children under the age of 13 unless it is provided directly by a child's parent or guardian or through the child's usage of the Services as a student in a school that uses the Flamingo Freelance Services.
- If we discover that we have collected Sensitive Information from a person under the age of 13 in violation of COPPA, we will destroy the information. If you feel a child under the age of 13 has provided us with Sensitive Information in violation of COPPA, please contact us at support@Flamingo Freelance.ai.
15.0 MISCELLANEOUS
- This serves to clarify and enhance the enforceability of Flamingo Freelance's Terms of Service.
15.1 Severability
- If any provision of this Agreement is illegal or unenforceable under applicable law, the remainder of the provision will be amended to achieve as closely as possible the effect of the original term, and all other provisions of this Agreement will continue in full force and effect.

- The paragraph headings in this Agreement are solely for the sake of convenience and will not be applied in the interpretation of this Agreement.
15.3 Amendments to the Platform
- We may, either partially or in its entirety and without being obligated to provide prior notice – modify, adapt or change the platform (or any of its content), the extent and availability of the contents on the Website, and any other aspect related to the Website. You will have no claim, complaint, or demand against us for applying such changes or for failures incidental to such changes.
15.4 Waiver
- Our failure to partly or fully exercise any rights, or our waiver of any violation of these Terms by user, shall not prohibit us from exercising such right in the future, nor shall it be regarded a waiver by us of any subsequent breach by you of the same or any other provision of these Terms. Our rights and remedies under these Terms and any other applicable agreement between you and us are cumulative, and exercising any such right or remedy does not preclude us from exercising any other right or remedy.
